Welcome to Alpha & Omega Air Conditioning. These Terms of Service (“Terms”) govern your use of our website (https://alphaomegaair.com.au/), our online store (https://store.alphaomegaair.com.au/), and the purchase of any products or services from us.

By accessing our website, booking a service, or purchasing products from our online store, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

Definitions


“Service” refers to any air conditioning installation, maintenance, repair, or consultation provided by our technicians.

“Product” refers to any hardware, split systems, ducted systems, parts, or accessories sold via our online store or directly to you.

“We”, “us”, “our” refers to Alpha & Omega Air Conditioning.

“You”, “your” refers to the customer, website visitor, or service user.

Australian Consumer Law (ACL)

Our Products and Services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms purports to modify, restrict, or exclude any statutory consumer rights or guarantees you have under the Competition and Consumer Act 2010 (Cth).

Quotes, Pricing, and Orders

Quotes: Any consultation or obligation-free quote provided by us is valid for 30 days from the date of issue unless specified otherwise in writing.

• Pricing: All prices displayed on our website and online store are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless stated otherwise.

• We reserve the right to change prices at any time without notice.

Order Acceptance: We reserve the right to accept or reject any order placed through our online store for any reason, including product unavailability, pricing errors, or suspected fraudulent activity. If we cancel an order, we will issue a full refund.

Payment Terms

Online Store: Payment for Products ordered online must be made in full at the time of purchase via our authorised secure payment gateways.

Services and Installations: For larger installation jobs, a deposit may be required before work commences. The remaining balance is strictly payable upon completion of the service or as detailed on your invoice.

Late Payments: We reserve the right to charge interest or administrative fees on any overdue invoices.

Delivery and Shipping (Online Store)

• We ship Products to specified locations within Australia. Shipping costs and estimated delivery timeframes will be calculated at checkout.

• While we make every effort to deliver your goods within the estimated timeframe, we are not liable for any delays caused by third-party courier services or events beyond our reasonable control.

Installation and Site Access

For on-site Services and installations, you agree to:

• Ensure our technicians have safe, clear, and unhindered access to the property at the scheduled time.

• Inform us of any known hazards, structural issues, or asbestos at the property prior to work commencing.

• Ensure an adult (over 18) is present at the property to authorise the work.

If a scheduled service call cannot go ahead because we cannot gain safe access to the site, a call-out or cancellation fee may apply.

Cancellations, Returns, and Refunds

Change of Mind: We are not legally required to provide a refund or replacement if you simply change your mind. Any returns for change of mind on online store purchases are at our absolute discretion and may incur a restocking fee.

• Service Cancellations: If you need to reschedule or cancel a booked service appointment, please give us at least 24 hours’ notice.

Faulty Products: If a Product or Service fails to meet a consumer guarantee under the ACL, you are entitled to a repair, replacement, or refund depending on whether the failure is minor or major.

Warranties

Manufacturer’s Warranty: Most products we sell come with a 5-year manufacturer’s warranty on parts and labour (subject to the manufacturer’s terms, which usually require regular servicing).

Installation Workmanship: We stand by our work. We provide a 12-month warranty on our installation workmanship. This does not cover faults caused by regular wear and tear, lack of maintenance, or unauthorized third-party modifications.

Limitation of Liability

To the maximum extent permitted by law, Alpha & Omega Air Conditioning will not be liable for any indirect, incidental, or consequential damages (including loss of revenue or profit) arising out of your use of our website, products, or services.

Our liability for breach of a non-excludable consumer guarantee is limited, at our option, to replacing or repairing the goods, or re-supplying the services.

Intellectual Property

All content on our website, including text, logos, graphics, and images, is the intellectual property of Alpha & Omega Air Conditioning or our licensors and is protected by Australian copyright laws.

You may not copy, reproduce, or distribute this content without our prior written consent.

Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales (NSW), Australia.

Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of NSW.
